Mercy Mutai is a Partner at the firm. She is a graduate of the University of Nairobi having attained her Bachelor of Laws (LLB) Second Class Honors, Upper Division. She has also completed her Diploma (ATP) at the Kenya School of Law. She is an Advocate of the High Court of Kenya holding a valid practicing certificate.
She serves at the Litigation and Tax Department having garnered experience in helping clients with Litigation matters as well as Tax Disputes. She has had previous working experience in the Banking and Finance Sector and Tax/Audit Sector. In the above sectors, Mercy has assisted Clients by providing legal advice by assisting them to engage in negotiating favorable settlements, mediation and arbitration. She has also represented Clients in the national courts, arbitral tribunals and before Government Agencies.
In the Tax Sector, Mercy has taken part in responding to tax inquiries/ concerns/findings raised by the Kenya Revenue Authority (KRA), objecting to tax assessments, filing of appeals to the Tax Appeals Tribunal, filing of further appeals to the mainstream courts, engaging with KRA on mediation sessions in view of reaching reasonable and favorable tax settlements and assisted clients in tax advisory.
In the Banking and Finance Sector, she has had experience in the drawing and review of contracts, preparing legal opinions and executive summaries. She has worked in the asset financing and leasing sub-sector, debt recovery, drafting and review of financing instruments like charges, discharge of charges, debentures, hire purchase agreements, guarantees as well as other related instruments.
